Genetix (“Genetix”, “we”, “us”, “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and protect your personal information when you visit our website, order a test, or use our services, in compliance with the Protection of Personal Information Act, 2013 (POPIA).

If you have any questions about this Policy, contact our Information Officer at info@genetixtests.co.za.

1. Who we are

Genetix is a precision genetic testing company based in South Africa, registered as Genetix Tests (Pty) Ltd, registration number 2021/797913/07, with a registered address at Office Suite 2, 108 Albert Rd 5th Floor, Woodstock, Cape Town, South Africa, 7925. Our website address is https://genetixtests.co.za.

2. Information we collect

Information you give us directly, such as when you book a test, create an account, or contact us:

  • Name, contact details (email, phone, physical address)
  • Date of birth and identity information, where required for clinical processing
  • Payment information, processed securely by our payment partner. We do not store your card details
  • Information you provide to our clinicians or genetic counsellors during consultations

Genetic and health information, collected as part of providing our testing services:

  • Your biological sample (blood, saliva, or stool, depending on the test)
  • The genetic and health data generated by analysing that sample
  • Any medical, medication, or lifestyle information you or your clinician provide to support interpretation of your results (for example, current medications for a PGx test)

Genetic and health information is classified as special personal information under POPIA. We only process it with your explicit consent, and only for the purpose of delivering your test results and related clinical support.

Information collected automatically, when you use our website:

  • IP address, browser type, device information
  • Pages and tests viewed, and how you interact with our site, via cookies and similar technologies
  • Cart contents, while you’re browsing and before you complete an order

3. How we use your information

We use your information to:

  • Process your order and deliver your test kit or arrange phlebotomy
  • Analyse your sample and generate your report
  • Provide your results to you and, where applicable, your treating clinician
  • Operate the PGx Live clinical portal, where relevant
  • Communicate with you about your order, results, or account
  • Process payments and prevent fraud
  • Improve our website and services
  • Meet our legal, regulatory, and laboratory accreditation obligations
  • Send you marketing communications, only where you have opted in

We do not use your genetic information for marketing purposes, and we do not sell your personal information to third parties.

4. Automated processing and profiling

Some of our reports, including our nutrigenomics and microbiome reports, are generated with the support of algorithmic and machine learning models. These models analyse your genetic or microbiome data against scientific and clinical reference databases to produce personalised insights and recommendations.

These automated processes support, but do not replace, clinical judgement. Reports intended for clinical use are designed to be interpreted by a licensed clinician, and you may request human review of any automated finding that materially affects you. To do so, contact our Information Officer.

5. Who we share your information with

We share information only where necessary to provide our services:

  • Laboratory and testing partners, including international suppliers whose technology underpins certain tests (for example, our microbiome and nutrigenomics partners). Where this involves transferring personal information outside South Africa, we ensure the recipient is bound by data protection terms that meet POPIA’s requirements
  • Payment partners, to process your payment securely
  • Courier partners, to deliver test kits and collect samples
  • Your treating clinician, where you have requested your results be shared with them
  • Analytics providers (verify: name the analytics tool in use, e.g. Google Analytics, and link to its privacy policy here)
  • Regulatory or legal authorities, where required by law

We never share your genetic or health information with marketers, advertisers, or insurers.

6. Data security

We use Secure Socket Layer (SSL) encryption across our website. All payment information is tokenised and handled by Peach Payments’ PCI-DSS Level 1 compliant systems. Genetic and health data is stored and processed under restricted access controls, in line with our laboratory’s accreditation requirements. Access to your genetic and health information is limited to team members who need it to process your order, generate your results, or support your care.

7. If something goes wrong

If we become aware of a security compromise that has affected, or may affect, your personal information, we will take reasonable steps to investigate and contain it, and will notify the Information Regulator and affected individuals as required under POPIA, without unreasonable delay.

8. How long we keep your information

We retain your personal and genetic information for as long as needed to provide our services, and afterwards for as long as required by South African law, laboratory accreditation standards, or our contractual obligations to testing partners and regulators. Order records, including billing and delivery details, are kept for five years for tax and accounting purposes.

9. Your rights

Under POPIA, you have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your information, subject to our legal and clinical retention obligations
  • Object to certain types of processing
  • Withdraw consent for the processing of your genetic information, where applicable

To exercise any of these rights, contact our Information Officer at info@genetixtests.co.za.

10. Children

Our services are not directed at individuals under the age of 18. Where testing is required for a minor, we require the consent of a parent or legal guardian.
